1. Who we are
The Merdello online store (merdello.com, the “Site”) is operated by Merdello, a business registered in Poland (EU), e-mail contact@merdello.com (“Merdello”, “we”, “us”). These Terms of Service (“Terms”) govern your access to and use of the Site and every purchase you make through it. By placing an order you agree to these Terms, our Refund Policy, Shipping Policy and Privacy Policy.
2. Eligibility
You must be at least 18 years old and able to enter into a binding contract to purchase from the Site. By ordering you confirm that the payment method you use is yours and that the information you provide is accurate and complete.
3. Products and product use
Merdello sells grooming products for the daily ear hygiene of dogs and cats. Our products are not medicines and are not intended to diagnose, treat, cure or prevent any disease. They do not replace veterinary care. If your pet shows signs of infection or injury — pain, discharge, redness, swelling, or a bad smell that persists despite cleaning — consult a veterinarian before use. Individual results vary. Always follow the directions on the label and keep the product out of reach of children.
4. Prices and payment
Prices are shown in US dollars and may change at any time; the price charged is the price displayed at checkout when you place your order. First-order and recurring charges for the first-bundle-free offer are set out in Section 5. Shipping charges and applicable taxes are shown before you confirm payment. Where a one-time purchase is offered, shipping costs $4.95. We accept the payment methods shown at checkout, including major credit and debit cards, Shop Pay and Apple Pay. By providing a payment method you authorize us (and our payment processor) to charge it for your order and, if you enroll in a subscription, for each subsequent refill as described in Section 5.
5. Order placement and acceptance; subscriptions, automatic payment and cancellation
All orders placed through the Site are subject to acceptance by Merdello. We may, in our sole discretion, refuse or cancel any order, including if a product is unavailable, if a pricing or product description error is identified, or if we suspect fraud. If we cancel an order after your payment method has been charged, we will issue a refund for the amount charged.
These prices apply to the first-bundle-free subscription offer when it is shown on the product page and at checkout.
A subscription is required to receive the first bundle free. The available bundles are The Smell Fix (1 bottle), The Full Reset (2 bottles), and The Complete Care (3 bottles).
Your first bundle of Merdello Ear Drops costs $0.00. You pay shipping for the first order:
- 1 bottle: $12.99 shipping.
- 2 bottles: $19.99 shipping.
- 3 bottles: $24.99 shipping.
Your first refill is scheduled 30 days after your first order. Starting with that refill, your subscription renews automatically every 30 days at the following price for the full bundle:
- 1 bottle: $29.99 per order.
- 2 bottles: $39.99 per order.
- 3 bottles: $59.99 per order.
Shipping is free on every refill. Your payment method is charged automatically for each renewal until you cancel. All prices are in US dollars. Any applicable taxes are shown at checkout.
Your first payment, recurring payment and billing frequency are shown at checkout before you place your order.
Orders placed under a different offer and existing subscriptions keep the pricing and shipping terms confirmed when you purchased or enrolled.
By enrolling in a subscription you authorize Merdello to charge your payment method for each shipment. Each payment will be automatically processed at the time of each shipment and billed to the payment method you provided. If your payment method fails, Merdello may charge any other valid payment method you have provided on file in order to process and fulfill your subscription order.
You may cancel your subscription at any time. You must cancel your subscription twenty-four (24) hours prior to your next shipment going out in order to not receive your next scheduled order. To cancel, log in to your customer account, open Manage subscription and select Cancel subscription. Once a subscription order has been processed and shipped, it cannot be cancelled; see our Refund Policy for return and refund options.
After enrollment you will receive an e-mail confirming your subscription and its terms, including the price, billing frequency and how to cancel.
6. Shipping
We currently ship to addresses in the United States. Orders are packed within 24–48 hours and typically delivered within 7–12 days. For the first-bundle-free offer, first-order shipping costs $12.99 for 1 bottle, $19.99 for 2 bottles, or $24.99 for 3 bottles. Shipping is free on every refill. Existing subscriptions keep their agreed shipping terms. Where a one-time purchase is offered, shipping costs $4.95. Risk of loss passes to you upon delivery to the address you provided. Optional Shipping Protection ($2.99 per order, provided by Merdello) covers loss, damage, theft after delivery and packages not delivered within 30 days of dispatch; orders without it are handled as described in our Shipping Policy, which forms part of these Terms.
7. Returns and refunds
Our 90-Day Money-Back Guarantee covers refill orders: unopened bottles with the seal intact can be returned for a full refund of that refill within 90 days of its delivery. The free first bundle and the shipping charge paid for it are not refundable. The conditions, the refund procedure and the rules for subscription orders are set out in our Refund Policy, which forms part of these Terms.
8. Promotions and discount codes
Any offer-specific conditions are shown at checkout. Discount codes cannot be combined unless stated otherwise, must be applied at checkout, and may be modified or withdrawn at any time. We may limit quantities per customer or per order.
9. Intellectual property
The Site and all of its content — text, images, video, logos, product names and design — are owned by or licensed to Merdello and protected by copyright and trademark laws. You may not copy, reproduce, distribute or create derivative works from any part of the Site without our prior written consent.
10. Disclaimer of warranties
Except as expressly stated in these Terms or our Refund Policy, the Site and the products are provided “as is” and “as available”. To the fullest extent permitted by law, Merdello disclaims all warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.
11. Limitation of liability
To the fullest extent permitted by law, Merdello will not be liable for any indirect, incidental, special, consequential or punitive damages arising out of or related to your use of the Site or the products. Our total liability for any claim relating to an order will not exceed the amount you paid for that order. Nothing in these Terms limits any liability that cannot be limited under applicable law, including any non-waivable rights you have as a consumer under the laws of your state of residence.
12. Indemnification
You agree to indemnify and hold Merdello harmless from any claims, losses or expenses (including reasonable attorneys’ fees) arising from your breach of these Terms or your misuse of the Site or the products.
13. Governing law and disputes
These Terms are governed by the laws of Poland, without regard to its conflict-of-law rules, except that nothing in these Terms deprives you of the protection of mandatory consumer laws of your state or country of residence. If you have a problem with an order, please contact us first at contact@merdello.com — we resolve almost every issue by e-mail within a few days. Any dispute that cannot be resolved informally may be brought in the courts of Poland or, where mandatory consumer law so provides, in the courts of your place of residence.
14. Changes to these Terms
We may update these Terms from time to time. The version in force on the day you place an order applies to that order. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
