1. Who we are

The Merdello online store (merdello.com, the “Site”) is operated by Merdello, a business registered in Poland (EU), e-mail contact@merdello.com (“Merdello”, “we”, “us”). These Terms of Service (“Terms”) govern your access to and use of the Site and every purchase you make through it. By placing an order you agree to these Terms, our Refund Policy, Shipping Policy and Privacy Policy.

2. Eligibility

You must be at least 18 years old and able to enter into a binding contract to purchase from the Site. By ordering you confirm that the payment method you use is yours and that the information you provide is accurate and complete.

3. Products and product use

Merdello sells grooming products for the daily ear hygiene of dogs and cats. Our products are not medicines and are not intended to diagnose, treat, cure or prevent any disease. They do not replace veterinary care. If your pet shows signs of infection or injury — pain, discharge, redness, swelling, or a bad smell that persists despite cleaning — consult a veterinarian before use. Individual results vary. Always follow the directions on the label and keep the product out of reach of children.

4. Prices and payment

Prices are shown in US dollars and may change at any time; the price charged is the price displayed at checkout when you place your order. Shipping is free on subscription orders; one-time purchases are charged a flat $4.95 shipping fee shown at checkout. Applicable taxes are shown before you confirm payment. We accept the payment methods shown at checkout, including major credit and debit cards, Shop Pay and Apple Pay. By providing a payment method you authorize us (and our payment processor) to charge it for your order and, if you enroll in a subscription, for each subsequent refill as described in Section 5.

5. Order placement and acceptance; subscriptions, automatic payment and cancellation

All orders placed through the Site are subject to acceptance by Merdello. We may, in our sole discretion, refuse or cancel any order, including if a product is unavailable, if a pricing or product description error is identified, or if we suspect fraud. If we cancel an order after your payment method has been charged, we will issue a refund for the amount charged.

If you enroll in a subscription, it is automatically billed every twenty-eight (28) days to the payment method you provided at enrollment. Your first order is billed at the introductory price displayed at checkout; each subsequent refill order is billed at the refill price displayed on the product page at the time of enrollment. You may adjust your delivery date or frequency by logging into your customer account.

By enrolling in a subscription you authorize Merdello to charge your payment method for each shipment. Each payment will be automatically processed at the time of each shipment and billed to the payment method you provided. If your payment method fails, Merdello may charge any other valid payment method you have provided on file in order to process and fulfill your subscription order.

You may cancel your subscription at any time. You must cancel your subscription twenty-four (24) hours prior to your next shipment going out in order to not receive your next scheduled order. You can cancel by logging into your customer account (Manage subscription), by emailing us at contact@merdello.com, or by direct messaging us at @merdello on Instagram or Facebook. Once a subscription order has been processed and shipped, it cannot be cancelled; see our Refund Policy for return and refund options.

After enrollment you will receive an e-mail confirming your subscription and its terms, including the price, billing frequency and how to cancel.

6. Shipping

We currently ship to addresses in the United States. Orders are packed within 24–48 hours and typically delivered within 7–12 days. Shipping is free on every subscription order — first orders and refills of every bundle; one-time purchases ship for a flat $4.95. Risk of loss passes to you upon delivery to the address you provided. Optional Shipping Protection ($2.99 per order, provided by Merdello) covers loss, damage, theft after delivery and packages not delivered within 30 days of dispatch; orders without it are handled as described in our Shipping Policy, which forms part of these Terms.

7. Returns and refunds

Every first order is covered by our 100-Day Money-Back Guarantee. The conditions, the refund procedure and the rules for subscription orders are set out in our Refund Policy, which forms part of these Terms.

8. Promotions and discount codes

Introductory prices apply to your first order only. Discount codes cannot be combined unless stated otherwise, must be applied at checkout, and may be modified or withdrawn at any time. We may limit quantities per customer or per order.

9. Intellectual property

The Site and all of its content — text, images, video, logos, product names and design — are owned by or licensed to Merdello and protected by copyright and trademark laws. You may not copy, reproduce, distribute or create derivative works from any part of the Site without our prior written consent.

10. Disclaimer of warranties

Except as expressly stated in these Terms or our Refund Policy, the Site and the products are provided “as is” and “as available”. To the fullest extent permitted by law, Merdello disclaims all warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.

11. Limitation of liability

To the fullest extent permitted by law, Merdello will not be liable for any indirect, incidental, special, consequential or punitive damages arising out of or related to your use of the Site or the products. Our total liability for any claim relating to an order will not exceed the amount you paid for that order. Nothing in these Terms limits any liability that cannot be limited under applicable law, including any non-waivable rights you have as a consumer under the laws of your state of residence.

12. Indemnification

You agree to indemnify and hold Merdello harmless from any claims, losses or expenses (including reasonable attorneys’ fees) arising from your breach of these Terms or your misuse of the Site or the products.

13. Governing law and disputes

These Terms are governed by the laws of Poland, without regard to its conflict-of-law rules, except that nothing in these Terms deprives you of the protection of mandatory consumer laws of your state or country of residence. If you have a problem with an order, please contact us first at contact@merdello.com — we resolve almost every issue by e-mail within a few days. Any dispute that cannot be resolved informally may be brought in the courts of Poland or, where mandatory consumer law so provides, in the courts of your place of residence.

14. Changes to these Terms

We may update these Terms from time to time. The version in force on the day you place an order applies to that order. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
